1. Introduction

Welcome to Land of Assets ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, API, SDK, CLI, and services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you are using the Services on behalf of an organization, you are agreeing to these Terms for that organization and representing that you have the authority to bind that organization to these terms.

2. Description of Service

Land of Assets provides hosting, versioning, collaboration, and CDN delivery services for 3D assets (including but not limited to GLB/glTF files, images, and other digital content).

3. User Accounts

  • Registration: You must provide accurate and complete information when creating an account.
  • Security: You are responsible for maintaining the security of your account credentials (including API tokens) and for all activities that occur under your account.
  • Age: You must be at least 13 years old to use the Services.

4. User Content and Ownership

4.1. Your Ownership

You retain full ownership of all 3D models, files, and other content ("User Content") that you upload to the Services. We claim no intellectual property rights over the material you provide to the Services.

4.2. License to Land of Assets

In order to provide the Services, you grant us a worldwide, non-exclusive, royalty-free license to host, store, cache, reproduce, modify (for the purpose of creating thumbnails, optimizing formats, or compression), and distribute your User Content solely for the purpose of operating, developing, providing, and using the Services.

4.3. Public vs. Private Assets

  • Public Assets: Content you designate as "Public" will be accessible to anyone on the internet. You grant us the right to display these assets in our public search engine and gallery. Other users may view, download, or use your Public Content subject to the license you apply to that content (e.g., Creative Commons).
  • Private Assets: Content you designate as "Private" (available in paid plans or specific organization settings) will only be accessible to you and authorized members of your organization or project. We will not display Private Content in public search results.

5. Acceptable Use

You agree not to use the Services to:

  • Upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or invasive of another's privacy.
  • Upload content that infringes on any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
  • Distribute malware, viruses, or any other computer code designed to interrupt or damage the functionality of the Services.
  • Interfere with or disrupt the integrity or performance of the Services.
  • Attempt to gain unauthorized access to the Services or related systems.

6. Content Reporting

We take intellectual property rights and community safety seriously.

  • Reporting Tools: The most effective way to report infringing content, abusive comments, or violations of our Community Guidelines is to use the built-in reporting tools located on the asset or comment in question.

7. Fees and Payments

  • Free Tier: We offer a free tier for public open-source projects.
  • Paid Plans: Commercial usage and private assets may require a paid subscription. Fees are billed in advance and are non-refundable unless otherwise required by law.
  • Changes: We reserve the right to change our pricing upon notice to you.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

IN NO EVENT SHALL LAND OF ASSETS, ITS FOUNDERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.
